The Fresno Bee recently reported a case in which a Fresno criminal defense lawyer from our firm helped reach a "packaged plea deal" that allows defendants to get felony probation instead of years in state prison. Attorney Michael J. Aed provided defense for a 21-year-old man who was one of four defendants in the case,according to the Fresno Bee article . The defendants, most of whom were identified as gang members, were facing serious felony charges after an alleged assault outside a nightclub that left two other men severely beaten. The defendants were also charged with drug crimes and weapons-related crimes.
According to the Fresno Bee article, four of the men entered no contest pleas to the charge of assault likely to commit great bodily injury. Attorney Aed's client also pleaded no contest to a charge of drug possession. Also, the father of Attorney Aed's client entered a plea of no contest to the offense of possession of a firearm by a felon. As a result of these pleas, the defendants were successful in getting other charges dismissed. These included a second assault charge for each of the defendants, felony drug charges against two of the defendants (including Attorney Aed's client), and felony ammunition charges for the other two defendants. According to what Attorney Aed told The Fresno Bee, the defendants were previously at risk of serving a minimum of 10 years in prison.
In the news story, Attorney Aed explained the defendant's side of the story. He stated that the altercation was actually sparked by one of the alleged victims, who the lawyer said was to be the first one to throw a punch. The Fresno Bee quoted Mr. Aed saying that "mutual combat" could have been an argument for the defense. He added that the video footage being used as evidence in the case only shows a small part of what happened.
